<p>Of the $176.1 million spent by outside groups using large, often undisclosed contributions to influence the current elections, just 10 groups are responsible for the bulk of the spending, according to a new analysis released today by <a class="zem_slink" title="Public Citizen" rel="homepage" href="http://www.citizen.org">Public Citizen</a>.</p>
<p>What’s more, 59.9 percent of the <a class="zem_slink" title="Money" rel="wikipedia" href="http://en.wikipedia.org/wiki/Money">money</a> comes from undisclosed sources. Of those contributions that have been disclosed, nearly two-thirds has come from just 0.12 percent of the contributors. <a href="http://www.citizen.org/documents/2010-Independent-Electioneering-Activities.pdf">The analysis of data from Public Citizen’s Stealth PACs database </a>shows that:</p>
<ul>
<li>At least 149 independent groups have spent money to influence this year’s elections  (according to <a class="zem_slink" title="Federal Election Commission" rel="homepage" href="http://www.fec.gov">Federal Election Commission</a> (FEC) reports through Oct. 25) in the wake of the <a class="zem_slink" title="Supreme Court of the United States" rel="geolocation" href="http://maps.google.com/maps?ll=38.8907083333,-77.0043444444&amp;spn=1.0,1.0&amp;q=38.8907083333,-77.0043444444%20%28Supreme%20Court%20of%20the%20United%20States%29&amp;t=h">U.S. Supreme Court</a>’s decision in <a class="zem_slink" title="Citizens United v. Federal Election Commission" rel="wikipedia" href="http://en.wikipedia.org/wiki/Citizens_United_v._Federal_Election_Commission">Citizens United v. Federal Election Commission</a>, which permitted corporations, unions and organizations they fund to spend unlimited money to influence elections.</li>
</ul>
<ul>
<li>Those groups have spent $176.1 million. Of that, $114.6 million, or 65 percent, was spent by only 10 groups.</li>
</ul>
<ul>
<li>From the 10 groups, money spent on behalf of <a class="zem_slink" title="Republican Party (United States)" rel="homepage" href="http://www.gop.com/">Republicans</a> has outpaced money spent on behalf of <a class="zem_slink" title="Democratic Party (United States)" rel="homepage" href="http://www.democrats.org/">Democrats</a> $79.4 million to $28.5 million.</li>
</ul>
<ul>
<li>Five groups have spent money on more than 35 races each. Eleven groups have spent money on more than 20 races each.</li>
</ul>
<ul>
<li>Eighty groups have not disclosed any information about the sources of their money. These groups have spent $105.4 million of the $176.1 million total. Only $70.7 million of the spending – just 40.1 percent – has come from disclosed sources.</li>
</ul>
<ul>
<li>Thirty groups have entered the fray for the first time in 2010 in the past two weeks.</li>
</ul>
<p>“Outside group funding is shaking the foundations of our electoral democracy, but the situation is far worse than it seems at first blush,” said Robert Weissman, president of Public Citizen. “A tiny number of organizations, relying on a tiny number of corporate and fat cat contributors, are spending most of the money on the vicious attack ads dominating the airwaves. The vast majority of donors remain hidden behind a veil of secrecy, in many cases of doubtful legality. The biggest surge in funding will come in the next week. And this election cycle’s spending is merely a prelude to something far worse in 2012. The trigger for all this was the Supreme Court’s decision in <a class="zem_slink" title="Citizens United" rel="imdb" href="http://www.imdb.com/company/co0134333/">Citizens United</a>; the key to repairing our democracy is a constitutional amendment to undo the decision.”</p>
<p>The analysis includes charts identifying the groups spending the most to influence this year’s elections, the groups engaged in the most contests, the races that have been the subject of the most outside spending and the contests focused on by the independent groups that have sprung up in the past two weeks.</p>
<p><a href="http://www.citizen.org/stealthpacs">The Stealth PACs site allows users to search</a> the expenditures and limited contribution data of independent groups that are intervening in this year’s elections using contributions of more than $5,000 or undisclosed contributions.</p>
<p>The site also enumerates the outside groups’ expenditures on each race, discloses the vendors and other recipients of expenditures of $1,000 or more, and provides links to the FEC filings on expenditure data.</p>

<p>We were thrilled by TXU’s announcement last week that it will team with SolarCity to provide an option for residents wanting to install rooftop solar panels. The $35-per-month leasing program provides an innovative way to offset the high upfront cost of solar, which is the largest barrier to residents powering their homes with solar and selling electricity back to their retail electric provider.</p>
<p>But it’s difficult for other providers to follow this example because they don’t have the cash reserves for such subsidies. The TXU program relies on an Oncor rebate program created as part of the negotiated 2007 buyout of TXU by Energy Future Holdings.</p>
<p>The program will not be sustainable once the Oncor funding is exhausted. So Texas should create a statewide incentive for distributed renewable energy within its existing renewable energy program.</p>
<p>Since the TXU/SolarCity announcement, more than 2,000 Texans have called to ask for more details. Clearly, demand exists for solar in Texas.</p>
<p>Our state has the most solar radiation in the country, we are home to the world’s largest supplier of solar-grade silicon, and we are great innovators in the high-tech industry. Texas would be a natural home for the nation’s solar industry.</p>
<p>But we need leadership to get us there. By providing incentives to help Texans put solar panels on the roofs of homes and businesses and by building large-scale solar farms, we can clean the air, create good manufacturing jobs and become a national leader in solar power.<!--more--></p>
<p>The best way for Texas to ensure that this happens is by committing to a 10-year market development program that includes financial incentives and new construction design policies. With even a modest investment, we can help create economies of scale to make solar affordable for everyone and create a major economic engine for the state.</p>
<p>As a first step, the Public Utility Commission should use its authority to implement a 500-megawatt “non-wind” 2015 goal in our state renewable energy law and include a 100-megawatt program for distributed renewable energy generation.</p>
<p>Additionally, we should work with all stakeholders to ensure that retail electric providers offer fair buyback rates to electric customers who produce a surplus of electricity and are able to put electricity back on the grid. These policies would be an important down payment for solar that we can improve on in the 82nd Legislature as we look ahead to 2020 and beyond.</p>
<p>According to a survey done by the governor’s own pollster, “There is a statewide consensus to ‘require’ electric companies to provide a certain percentage of their product from renewable sources such as wind and solar.</p>
<p>Support crossed party, racial and gender lines — 86 percent of Democrats, 59 percent of Republicans, 89 percent of Hispanics, 84 percent of females under the age of 55 and 61 percent of males over the age of 55.”</p>
<p>Texas should adopt a solar program and make sure we don’t miss out on what is sure to become a major economic driver for the 21st century.</p>

Maurice Clemmons was but a single example of a mentally unstable felon.  Where was his follow up?  Where was his parole officer? Where was the mental health infrastructure that could have defused this violent explosion?</p>

			<content:encoded><![CDATA[<p>While attending the <a href="http://cleantx.org/">Austin CleanTX foundation</a> panel to hear their take on a <a href="http://cleantx.org/baseloadpower.html?page_id=80">post-legislative wrap-up</a>, we overheard Governor Perry’s energy advisor Brian Lloyd say the following:</p>

<p>Ouch!!    While I don’t think Mr. Lloyd literally supports imprisoning his political adversaries and their supporters, it is somewhat surreal to hear one of our public figures suggesting it.  I’ve been told that people often express their true feelings when they are joking, especially when they are not comfortable saying these things in any other context.  No matter how you look at it, it is a little troubling that the Governor’s Advisor would suggest that we lock up people who disagree with him.</p>
<p>Mr. Lloyd’s quip was offered as an explanation for the failure of certain Solar Bills this session, but of course the real culprit here was the voter ID bill introduced by the conservative wing of the Republican party in both houses.  This created a lot of partisan heat but no light as it killed not only legislation that would have promoted solar energy here in Texas, but also the Sunset safety bill (for which a special session was held last week).    This exchange shows that Mr. Lloyd dismisses those of us who are concerned about the environment as minor irritants and our concerns as ill-conceived.   I hope he will note that while he does dismiss our concerns, we our numerous and we can influence policy.</p>

<p>Dismiss talk of global warming and environmentalism if you must. But times are changing fast and, along with them, the very way we heat and cool our homes and businesses.</p>
<p>The Texas Senate signaled as much this week, approving a bill encouraging development of solar energy plants to generate electricity, much as the state has done in making wind an energy player in Texas and beyond.</p>
<p>Now it’s up to the House and Gov. Rick Perry to show similar vision for Texas.</p>
<p>We hope it isn’t much of a stretch. Sunshine is something we have plenty of in Texas — and we’re unlikely to run out of it anytime soon.</p>
<p>Passage of state Sen. Kirk Watson’s legislation, with help from Sen. Kip Averitt, R-Waco, is remarkable for a couple of reasons. For one thing, the Senate is dominated by Republicans. Watson is a Democrat.</p>
<p>Yet many lawmakers on both sides want to encourage the solar, geothermal and biomass energy aims in this bill. Some see the writing on the wall.</p>
<p>A Texas Public Utility Commission report issued Tuesday concludes that electricity prices could jump as much as $10 billion a year — $27 a month in the average electric bill — if Texans don’t anticipate looming federal greenhouse regulations aimed at cutting carbon-based fuels like natural gas and coal.</p>
<p>Environmentalists and lawmakers see Watson’s bill as neatly bolstering our state’s energy arsenal, especially as Texas continues to grow. Solar could help ensure energy offerings at peak times of the day, while wind will prove of greatest impact during the night hours.<span id="more-3330"></span></p>
<p>Plus, the PUC study says, displacing expensive natural gas with renewable energy could reduce overall energy costs, especially as technologies become more competitive. It can also help deter reliance on coal-fired power plants.</p>
<p>Beyond all this, the bill provides incentives when renewable energy is created by technology crafted or devised here in Texas.</p>
<p>The bill is quite timely: Congressional leaders in Washington, D.C., want to require that 15 percent of all electricity generated nationwide comes from sources such as solar, wind, geothermal and biomass by 2020, with another 5 percent coming through energy efficiency.</p>
<p>Strangely, state Sen. Troy Fraser led a handful of Republicans in voting against Watson’s bill — strange, we say, because a good bill by Fraser allows homeowners and businesses to qualify for rebates helping defray the cost of solar panels.</p>
<p>We find Fraser’s suggestion that Watson’s bill be shelved because there’s no need for it yet absurd, especially given Fraser’s hard push for a voter ID bill despite the dearth of evidence of in-person voting fraud anywhere in Texas.</p>

<p>There&#8217;s a lot to celebrate this Earth Day when it comes to the Texas Legislature. Republicans in both chambers are carrying environmental legislation &#8211; if for no other reason than to stick it to the feds before the feds, under President Obama and a Democratic Congress, begin regulating the environment themselves. And Speaker Joe Straus has been a boon to environmental bills, as well, since he&#8217;s actually letting the legislators run the show in the House, unlike his predecessor.</p>
<p>The upshot? More good environmental bills and fewer bad ones.</p>
<p>Luke Metzger, director of Environment Texas, says there are just two main bad bills this session. Both would both speed up the permitting process for power plants. Rep. Dan Flynn&#8217;s HB 2721, which is being heard today in Environmental Regulation, would speed it up for nuclear plants. The other bad bill, Rep. Randy Weber&#8217;s HB 4012, would fast-track permitting for coal power plants.</p>
<p>And I know it&#8217;s unlike us to report good news, but<strong> Tom &#8220;Smitty&#8221; Smith, director of Public Citizen in Texas</strong>, says he is <strong>&#8220;suffering from a crisis of abundance&#8221;</strong> when it comes to all the worthwhile environmental bills this session.</p>
<p><strong>&#8220;There are more good bills in the lege session than I can keep up with,&#8221; Smitty says. &#8220;It is reminiscent of the 1991 legislative session when Ann Richards was elected and there was a wave of reform. This is the best session I&#8217;ve had in 18 years.&#8221;</strong></p>

<p>But which of these good bills actually have a chance? Read about them after the jump.</p>
<p><span id="more-3059"></span></p>
<p>By this point in the session, it usually pretty clear what the &#8220;chosen&#8221; bills are &#8211; the ones that have the leadership and support to put up a good fight in a system designed to kill bills. These bills are often omnibus bills resulting from negotiations with legislators of both parties, industry representatives and advocates.</p>
<p>Of the dozens of environmental bills filed this session, here&#8217;s a rundown of which appear to be the chosen ones, and where they are in the process.</p>
<p>Energy Efficiency</p>
<p>&#8220;Energy efficiency&#8221; generally describes low-tech measures that reduce energy use, such as increasing insulation in buildings, replacing standard appliances with Energy Star appliances, and using compact fluorescent lighting rather than conventional.</p>
<p>On the Senate side is Troy Fraser&#8217;s SB 546, which would establish concrete goals for utilities to decrease their demand. The bill passed the Senate 29 -1 on April 20, and so it&#8217;s on its way to the House.</p>
<p>The chosen energy efficiency bill on the House side is Rafael Anchia&#8217;s HB 280, which also sets demand reduction goals &#8211; but was described by Smitty as &#8220;much more aggressive&#8221; as the Fraser bill.</p>
<p>Renewable Energy Resources</p>
<p>The big solar bill on the Senate side is also Fraser&#8217;s. SB 545 is an incentive program that would primarily promote the use of rooftop solar panels, mostly for private residences. It passed out of the Senate yesterday, 25-4.</p>
<p>On the House side, it&#8217;s still up in the air which bills will emerge as the chosen ones. The major contenders, authored by Reps. David Swinford and Mark Strama, may get out of committee as early as this week and hit the House floor next week. Stay tuned.</p>
<p>Senate Bill 16</p>
<p>And finally, there&#8217;s Sen. Kip Averitt&#8217;s SB 16, which has been pegged as a big&#8217;un since the beginning of the session, and passed the Senate a couple weeks ago.. The bill is an omnibus clean air act which requires, among other things, better building codes, appliance standards, improved incentives for plug-in hybrid vehicles and more oversight when it comes to power plant locations and specs. It will be heard in House Environmental Regulation sometime next week.</p></blockquote>
