<p>Today the <a href="http://www.lcra.org/about/leadership/board/index.html">Lower Colorado River Authority (LCRA) Board of Directors</a> delayed a vote on providing water to the <a href="http://nocoalcoalition.org/">&#8220;White Stallion&#8221; coal plant</a> proposed for Matagorda County. Though White Stallion&#8217;s Chief Operation Officer, Randy Bird, was expecting and asking for approval of a contract today, the board chose to delay action until August 10. This makes sense considering that they were confronted with more than 30 people who signed up to speak against the coal plant, some driving from as far away as the Gulf Coast (some taking off work) in order to be there. This delay is a victory for those opposing the coal plant and a step in the right direction in convincing the LCRA that this project is not a beneficial or responsible use of water from the Colorado River Basin.</p>
<p>Key concerns included the general aspect of this project and the negative effects it would have on the people, environment (and watershed) of the region. There were also, as expected, many concerns regarding the current drought and many agreements that the last thing LCRA should consider is adding more, firm water commitments particularly when LCRA is already asking customers to conserve and scale back their water use. Concerns about how global warming would further worsen dry conditions in the region over the next 55 years (the length of the proposed contract) were also voiced by many of the speakers.</p>
<p>&#8220;Even though they haven&#8217;t denied it yet, we&#8217;re glad they&#8217;re taking their time to look into the serious implications of this coal plant request&#8221; said Lydia Avila with Sierra Club.  &#8220;We&#8217;re confident that when they look at the facts they will realize this is a bad deal for Texans and reject it.&#8221;</p>
<p>Only one or two people spoke in favor of granting the contract, one of whom was Owen Bludau, Executive Director of the <a href="http://www.mcedc.net/">Matagorda County Economic Development Corporation</a> &#8211; one of the original entities that worked to bring the White Stallion proposal to Bay City. Those speaking against the contract included Matagorda County Judge Nate McDonald, Burnet County Judge Donna Klaeger, David Weinberg (Executive Director of the Texas League of Conservation Voters), Doctor Lauren Ross (who recently released <a href="http://texasgreenreport.files.wordpress.com/2011/06/lcrawateravailabilityreport-06june2011.pdf">this report </a>on how White Stallion would affect water in the Colorado watershed), and many others including concerned residents throughout the LCRA region and landowners located right next to the proposed plant site.</p>
<p>Public Citizen applauds LCRA&#8217;s decision to table this vote. It shows that the LCRA takes the concerns of their stakeholders seriously. The next two months should prove to the LCRA that this coal plant is both unnecessary and a waste of our most precious and dwindling resource: our water.</p>

			<content:encoded><![CDATA[<p><a href="http://texasvox.files.wordpress.com/2010/11/scales-of-justice.jpg"><img class="alignright size-full wp-image-10584" title="scales of justice" src="http://texasvox.files.wordpress.com/2010/11/scales-of-justice.jpg?w=500" alt=""   /></a>Last week, the <a title="US Court of Appeals, 5th Circuit" href="http://www.ca5.uscourts.gov/" target="_blank"><strong><em>U.S. 5<sup>th</sup> Circuit Court of Appeals</em></strong> </a>awarded a major victory to <strong><a title="Public Citizen Texas" href="www.citizen.org/texas" target="_blank">Public Citizen </a></strong>and <strong><a class="zem_slink" title="Sierra Club" rel="homepage" href="http://www.sierraclub.org/">Sierra Club</a></strong> in their long standing efforts to block the Sandy Creek coal plant near Waco when it ruled that developers improperly started construction without adequate clearance under the federal <strong><em><a class="zem_slink" title="Clean Air Act" rel="wikipedia" href="http://en.wikipedia.org/wiki/Clean_Air_Act">Clean Air Act</a></em></strong>.</p>
<p>The court overturned a district court ruling saying the developers of the <strong><em>Sandy Creek Power Plant</em></strong> should have been required to show that they would employ the “<a title="MACT" href="http://www.epa.gov/epawaste/hazard/tsd/td/combust/index.htm" target="_blank">maximum achievable control technology</a>” (MACT) to limit the emissions of mercury and other pollutants once the plant was up and running.</p>
<p>In 2006 the <strong><em>Texas Commission on Environmental Quality</em></strong> (TCEQ) issued the permit for <strong><em>Sandy Creek</em></strong>, relying on an <strong><em>Environmental Protection Agency </em></strong>(EPA)  ruling from the year before exempting coal- and oil-fired generating plants from the MACT standard.</p>
<p>In 2008, an appeals court struck down the EPA’s earlier ruling and, even though construction had already started on <strong><em>Sandy Creek</em></strong>, the <strong><em>Sierra Club</em></strong> and <strong><em>Public Citizen</em></strong> filed a lawsuit arguing that work could not go forward because the plant had not shown it could meet MACT standard.</p>
<p>The district court sided with Sandy Creek because it had commenced with construction, and that, at the time, the plant was in compliance with the rules in place.</p>
<p>The circuit court said in its ruling that because the EPA was wrong to exempt coal plants from the MACT standard, Sandy Creek cannot rely on that exemption to continue construction without a proper permit, and sent the case back to the district court.</p>

<p>“Overall these recommendations, if adopted, will create a leaner, smarter agency &#8211; with a name reflecting its mission &#8211; the Texas Oil and Gas Commission. Eliminating the 3 fulltime elected commissioners and other changes would save the state an estimated $23 million a year. Under staff recommendations natural gas rate-cases would be moved to the <a class="zem_slink" title="Public utilities commission" rel="wikipedia" href="http://en.wikipedia.org/wiki/Public_utilities_commission">Public Utilities Commission</a> (also under Sunset this year), and enforcement disputes would be moved from being resolved by a judge beholden to the agency to the State Office of Administrative Hearings (SOAH). In addition the Commission would end the promotion of propane as a fuel, and rely more on administrative and regulatory fees to pay for their activities, rather than depend on general revenue” said Andy Wilson, a policy analyst for Public Citizen who studies good government, campaign finance, and climate change.</p>
<p>Advocates point out problems that are still likely to occur if staff recommendations are adopted, due to overlapping regulatory authority with other state agencies over issues including oil and gas drilling, coal ash waste, and uranium mining. “Sunset Staff has failed to clearly define which agency (<a class="zem_slink" title="Texas Commission on Environmental Quality" rel="wikipedia" href="http://en.wikipedia.org/wiki/Texas_Commission_on_Environmental_Quality">TCEQ</a> or RRC) will deal with what regulatory aspects of oil and gas drilling, particularly in the Barnett Shale,” said Cyrus Reed, Conservation Director of the Lone Star Chapter of the Sierra Club. He added, “Texans deserve a single agency to regulate coal ash waste and uranium mining, rather than have regulatory authority at two different agencies, which confuses both industry and the general public.”</p>
<p>“Fracking or drilling in suburban areas represents one of the largest environmental issues facing Texas today.  Letting the Railroad Commission and TCEQ continue to share turf here is essentially punting,” added Wilson.</p>
<p>“Moving to an appointed board rather than an elected one is a smart choice, removing the inherent conflicts of interest and partisan politics created by our campaign finance system,” said Wilson.  “According to our analysis, over half of all campaign contributions to incumbent members of the Railroad Commission come from industries they are in charge of directly regulating.”</p>
<p>“However, there is no need to have a 5 person board when a 3 person commission will do.  Changing to this kind of board is already estimated to save $1.2 million— having a three person board will increase savings in this tight budget year,” added Wilson.</p>
<p>Also, according to Texas Open Meetings laws, two members of a five person board may confer with one another in private, while a three person board can only conduct business in public, open meetings.  “That could be a case of two steps forward, one step back,” said Wilson.</p>

<p id="id2428582">Coal-fired power plants in <a class="zem_slink" title="Texas" rel="geolocation" href="http://maps.google.com/maps?ll=31.0,-100.0&amp;spn=10.0,10.0&amp;q=31.0,-100.0 (Texas)&amp;t=h">Texas</a> are responsible for dozens of bad air days in neighboring states each year, according to a new analysis released by the Sierra Club.  The report attributes as many as 64 days of harmful levels of smog in <a class="zem_slink" title="Oklahoma" rel="geolocation" href="http://maps.google.com/maps?ll=35.5,-98.0&amp;spn=3.0,3.0&amp;q=35.5,-98.0 (Oklahoma)&amp;t=h">Oklahoma</a> to Texas&#8217; coal plants. It also ties the plants to as many as 20 days of unhealthy air in <a class="zem_slink" title="Arkansas" rel="geolocation" href="http://maps.google.com/maps?ll=34.8,-92.2&amp;spn=3.0,3.0&amp;q=34.8,-92.2 (Arkansas)&amp;t=h">Arkansas</a> and up to 16 in <a class="zem_slink" title="Louisiana" rel="geolocation" href="http://maps.google.com/maps?ll=31.0,-92.0&amp;spn=3.0,3.0&amp;q=31.0,-92.0 (Louisiana)&amp;t=h">Louisiana</a>.</p>
<p id="id2428600">The report supports earlier concerns raised by Oklahoma officials about the potential impacts on their state from the nearly 30 coal-fired plants either operating, permitted or proposed in Texas.</p>
<p id="id2428606">The attorney general for Oklahoma asked the federal <a class="zem_slink" title="United States Environmental Protection Agency" rel="homepage" href="http://www.epa.gov/">Environmental Protection Agency</a> in May to require Texas to show that the new plants will not foul the state&#8217;s air before issuing permits for construction.<span id="more-10268"></span></p>
<p id="id2428612">Sierra Club&#8217;s study used computer models to reveal the full extent of the Texas plants&#8217; impact on ozone, or smog, concentrations in other states. The models did not include any emissions source other than the coal plants.</p>
<p id="id2428619">Ozone is produced when pollutants from tailpipes and smokestacks, among other sources, cook in sunlight. Chronic exposure can cause asthma attacks, chest pain and premature death.</p>
<p id="id2428677">In Oklahoma, the study concluded that the proposed plants would cause another 11 days of dirty air north of the Red River over the 64 that exceeded the soon-to-be-finalized federal limits for ozone in the past year.</p>
<p>The Texas Commission on Environmental Quality found fault with the study, saying that it presented &#8220;a worst-case scenario&#8221; based on the assumption that all of the plants were operating at the same time at full capacity. The agency also questioned whether the modeling was done to EPA standards.</p>
<p id="id2428691">Earlier this year, the EPA acknowledged the problem of pollution in areas downwind of coal plants by proposing rules that would bring major reductions in soot and smog in 31 states, including Texas.</p>
<p id="id2428697">The new regulations will require aging coal-fired plants &#8211; many of which are more than 50 years old &#8211; to be upgraded with new controls for nitrogen oxides and sulfur dioxide. The rule is expected to cost $2.8 billion a year but promises greater health benefits.</p>
<p id="id2428704"><a class="zem_slink" title="Texas Commission on Environmental Quality" rel="wikipedia" href="http://en.wikipedia.org/wiki/Texas_Commission_on_Environmental_Quality">TCEQ</a> has criticized the proposal, asserting in formal comments to the EPA last month that Texas should not be identified as a &#8220;significant contributor&#8221; to any other place in violation of federal ozone limits. The agency also contends that the EPA&#8217;s rules would usurp its authority.</p>
<p id="id2428711">But environmentalists say the proposed rule doesn&#8217;t go far enough because it will not stop Texas from permitting more coal plants. The best we can hope for is that some companies may decide to retire older plants rather than invest in new control measures.</p>

<p>On Thursday, the TCEQ (Texas Commission of Environmental Quality) held a public meeting for the White Stallion Energy Center at the Bay City Civic Center to hear feedback on the plant&#8217;s application for a wastewater permit.<span id="more-9806"></span></p>

<p>Members of the TCEQ took questions and comments from the audience concerning the permit for the the 1,200-acre tract set to be the site of a 1,320-megawatt coal- and petcoke-fired power plant located on the east side of the <a class="zem_slink" title="Colorado River" rel="geolocation" href="http://maps.google.com/maps?ll=40.4722222222,-105.826111111&amp;spn=0.1,0.1&amp;q=40.4722222222,-105.826111111%20%28Colorado%20River%29&amp;t=h">Colorado River</a>, about 10 miles south of Bay City.</p>

<p style="padding-left:30px;">Donna Harris fears for her grandchildren&#8217;s future.  The fourth generation <a class="zem_slink" title="Matagorda County, Texas" rel="geolocation" href="http://maps.google.com/maps?ll=28.78,-96.0&amp;spn=1.0,1.0&amp;q=28.78,-96.0%20%28Matagorda%20County%2C%20Texas%29&amp;t=h">Matagorda County</a> resident owns a ranch house and raises cattle five miles from where the proposed White Stallion Energy Center plant would be constructed.</p>
<p style="padding-left:30px;">&#8220;Having a coal plant nearby will harm my grandchildren, and this will not be good for the environment,&#8221; she said. &#8221;I just want my grandchildren to have a safe place &#8230; and be able to go outside and fish.&#8221;</p>
<p>TCEQ and White Stallion Energy Center also took questions from residents with water concerns which is the next  step for White Stallion to meet since the 1,320 megawatt electric power generating station will need lots of water to operate.</p>
<p>White Stallion has submitted an application for a water contract from the <a class="zem_slink" title="Lower Colorado River Authority" rel="homepage" href="http://www.lcra.org/">Lower Colorado River Authority</a>; no action has been taken by the LCRA.</p>
<p>Environmental groups at the meeting such as No Coal Coalition, <a class="zem_slink" title="Sierra Club" rel="homepage" href="http://www.sierraclub.org/">Sierra Club</a> and <a class="zem_slink" title="Public Citizen" rel="homepage" href="http://www.citizen.org">Public Citizen</a> were in opposition to the plant, with the No Coal Coalition taking the position that this coal plant is a threat to the county&#8217;s bays, river, farm industry, health and environment.  The Coalition believes that while this coal plant would bring some jobs to the area, they are more concerned that the negative impact would far outweighs the benefits of having this plant in the county.</p>
<p>The TCEQ has 60 days to issue a response to comments concerning the wastewater permit and 30 days to respond to people who will request a contested case hearing,  Overall, the issuing of the wastewater permit can take up to a year.</p>

<p>Under the federal Clean Air Act, the EPA has the power to intervene  in any permitting process to make sure that polluters are complying with  the law.</p>
<p>In the case of the Las Brisas Energy Center, the situation is critical and we need the EPA to step in.  Pollution  will increase by 82%, they’ll dump 220 pounds of mercury a year, the  plant will use 3 million gallons of water a day, and Nueces and San  Patricio Counties will almost certainly reach ozone non-attainment  levels, which means pricey smog-checks for everybody and a rollback of  production for local industries.</p>
<p>So, we’ve decided to call the EPA’s enforcement offices. We have two sample scripts for you to help you out, and remember: <strong>don’t be nervous!</strong> They are nice people, so don’t forget to smile (even though they can’t see you) and say thanks!</p>

One of the few places they&#8217;ve decided to hold a hearing is Dallas. Coal ash waste facilities have never been properly regulated, despite the fact that coal ash is full of toxic pollutants and carcinogens. This is due primarily to the fact that the coal lobby wants to profit off of their waste by selling it to other industries for use in manufacturing products ranging from concrete to fertilizer.</p>
<p>Texas has 17 coal plants, all of which produce massive amounts of toxic coal ash waste that get stored either in slurry ponds (coal ash mixed with water) or in landfills.</p>

<p>The Sierra Club and Texas Environmental Justice are rolling out <a href="http://txcleanupfestival.blogspot.com/">the Great Texas Clean-Up Festival</a>, from 4-10 at the Discovery Green in Houston, an event expected to kick off a larger campaign to clean up Texas. <strong>Public Citizen is a coalition partner and will be there! <p>Headlining the event is Dallas native Ray Johnston with <a href="http://www.rayjohnstonband.com/home">the Ray Johnston Band</a>, a groovy, rock soul act with plenty of attitude.  Rounding out the event are Los Pistoleros de Texas, bluesman <a href="http://www.myspace.com/mrsglassblues">Mrs. Glass</a>, and country western singer songwriter <a href="http://www.myspace.com/robertellismusic">Robert Ellis</a>.</p>
<p>Expect keynote speaker State Senator Rodney Ellis of Houston to give a rip-roaring speech, flanked by the impassioned Ana Hernandez, three term representative from district 143 of Houston.</p>
<p>About a dozen Houston-based artists are expected to showcase, including Lizbeth Ortiz, who created <a href="http://lizbethortiz.com/images/hands_29tl.jpg">this piece, &#8220;Nurturing Hands&#8221;</a>.</p>
<p>There will be a Kids&#8217; Corner [possibly spelled Kidz Korner, at presstime we weren't sure] and plenty of political activism.</p>

<p><strong>The Public Citizen Texas Week in Review<span id="more-7260"></span></strong></p>
<p><strong>Tom Smitty Smith</strong> was in Andrews County this week meeting with concerned citizens about the proposed nuclear waste dump. Last spring <a href="http://texasvox.org/2009/03/06/andrews-county-a-radioactive-risk-for-west-texas/">the TCEQ approved</a> the waste dump, threatening the health of all Texans and the <a href="http://www.savetheogallalaaquifer.com/">Ogallala Aquifer</a>.</p>
<p><strong>David Power</strong> was in the Rio Grande Valley educating citizens about <a href="http://pacefinancing.org/">P.A.C.E.</a> (<a href="http://solarfinancing.1bog.org/municipal-solar-financing/">Property Assessed Clean Energy</a>) districts and the proposals for financing such solar system and energy efficiency retrofits. David has been working with <a href="http://www.iclei.org/index.php?id=iclei-home">ICLEI</a>, <a href="http://lonestar.sierraclub.org/">Sierra Club</a>, and <a href="http://www.edf.org/home.cfm">Environmental Defense Fund</a>, touring Texas cities to generate support for P.A.C.E. legislation, with the latest presentations in Brownsville and McAllen to non-profit and local government workers. He recommends that you look at the city of <a href="http://www.bouldercolorado.gov/www/pace/index.html">Boulder&#8217;s program</a> to learn more.</p>
<p><strong>Ryan Rittenhouse</strong> continued preparing for <a href="http://texasvox.org/2010/03/08/north-texas-public-hearing-on-ozone-pollution-have-your-voice-be-heard/">EPA hearings</a> regarding new ozone attainment standards. On Tuesday March 16th, Public Citizen and Sierra Club will be hosting this <a href="http://action.sierraclub.org/site/PageNavigator/Clean_Air_Texas">event</a>. Ryan is also researching and preparing a grant to fight the proposed construction of a <a href="http://www.sierraclub.org/environmentallaw/tarsands/">new tar sands pipeline</a>, which would bring <a href="http://www.youtube.com/watch?v=1jMwmdsq6ZY">the world&#8217;s dirtiest oil</a> from Canada all the way to Houston.</p>
<p><strong>Trevor Lovell</strong> and the campus green fund initiatives continued to move forward under ReEnergize Texas&#8217; &#8220;<a href="http://thinkgreenfund.org/blog/">Think Green ? Think Green Fund</a>&#8221; campaign. Student governments at UT San Antonio and the <a href="http://www.ntdaily.com/?p=7596">University of North Texas</a> have both officially sanctioned student votes on green funds. If the initiatives pass at both campuses, the funds will generate about $3.5 million over their five-year lifespans.</p>
<p><strong>Sarah McDonald</strong> led an intern workshop on utilizing the media for energy advocacy. She taught <a href="http://texasvox.org/2010/03/05/get-to-know-an-activist-mona-avalos/">Mona</a>, Andrew, and <a href="http://texasvox.org/2010/02/25/introducing-the-get-to-know-an-activist-series-patrick-reck/">Patrick</a> how to use media and social media tools to get coverage for environmental issues and how to tap into the online activist community.</p>
<p><strong>Melissa Sanchez</strong> went to Houston along with <a href="http://www.environmenttexas.org/">Environment Texas</a> and Sierra Club and presented the current coal plant situation in Texas to Hispanic media, including print, TV, and radio outlets. After the presentation, she gave a Spanish interview to Univision Dallas and Univision Austin on how the Fayette Coal Plant factors into the <a href="http://texasvox.org/2010/02/04/recommended-energy-generation-plan-presented-to-austin-city-council/">Austin Generation Plan</a> and our <a href="http://www.cleanenergyforaustin.org/">Clean Energy for Austin</a> Campaign.</p>
<p><strong>Intern Mona Avalos</strong> wrote her <a href="http://texasvox.org/2010/03/11/drop-by-drop-7-ways-texas-cities-can-conserve-water/">first blog</a> (Yea!) on the National Wildlife Federation and Sierra Club&#8217;s report on water conservation.</p>
<p><strong>Intern Andrew Sauls</strong> put together a contact list of the municipal properties East of I-35 to invite them to a webinar related to enregy. He also wants to let Austin know about free music shows for <a href="http://www.groovemine.com/musiccities_austin_sxswpreview">SXSW</a>.</p>
<p><strong>Intern Patrick Reck</strong> continued taping interviews for the Get to Know an Activist series. Patrick is also continuing to research how the United States spends its human energy through the Bureau of Labor Statistics. He vents his frustration at the extensive missing data through <a href="http://www.youtube.com/watch?v=21Zd8xPUQs8">song</a>.</p>

			<content:encoded><![CDATA[<p>The National Wildlife Federation and the Lone Star Chapter of the Sierra Club have created a splash with their latest report: <a href="http://texaswatermatters.org/dropbydrop.htm">Drop by Drop: 7 Ways Texas Cities Can Conserve Water</a>.</p>
<p>Austin should be proud. Out of 19 cities studied in this report, our capital city was highly ranked on outdoor water ordinances and has an aggressive toilet replacement program. San Antonio has also set the bar high for effective and diverse water efficiency programs across the country. The cities surveyed were measured on: water pricing structure, water saving goals, toilet replacement, conservation funding, and outdoor watering. Though many cities and towns across the nation have made great strides to reduce water use, the report&#8217;s conclusion is that most cities are not doing as much as they could to efficiently use existing water supplies.<span id="more-7207"></span></p>
<blockquote><p>&#8220;The best and cheapest source of water is the one that&#8217;s already on tap,&#8221; said Ken Kramer, state director of the Sierra Club. &#8220;The key measure of success for any water conservation program is reducing water use on a per person basis and we recognize that takes time. In this report, we looked at some measures cities can be using right now to see if they are moving in the right direction. Our review makes it clear that while a handful of cities are working to maximize their water-use efficiency, most cities are doing little to make the best use of existing water supplies.&#8221;</p></blockquote>
<p>As stated in the video Drop by Drop, both population increase and climate change are significant players in the reason behind our rapid water depletion. The population of Texas is expected to more than double by the year 2060, and the municipal and agriculture water demand will increase with it (<a href="http://www.twdb.state.tx.us/assistance/conservation/consindex.asp">Texas Water Development Board</a>). What does this mean? It means that as consumers of water we have a responsibility to be aware of what we can do to conserve and how to hold our city accountable.</p>
<p>How to start? (1) Read the study; it is user friendly; (2) share it with your family, friends, and co-workers; and (3) act on it. Be a part of the ripple that will conserve our water. Don&#8217;t watch it go down the drain.</p>

<p>Dozens of businesses and nonprofit organizations as well as more than 200 citizens have formed <a href="http://www.cleanenergyforaustin.com">Clean Energy for Austin</a>, a coalition whose purpose is to push Austin City Council to adopt a clean energy plan. Specifically, the coalition supports the passage of Austin Energy’s Resource and Climate Protection Plan and recommendations of a city task force created to examine the plan. Coalition members support the plan because of its emphasis on renewable energy and efficiency, green jobs creation and careful consideration of Austin’s low-income residents.</p>
<p>To date, more than 70 businesses, 18 non-profit organizations and more than 200 individuals have signed on in support of the energy plan through <a href="http://www.cleanenergyforaustin.org/">www.cleanenergyforaustin.org</a>.</p>
<p>The energy plan is a road map for how Austin Energy, the city-owned electric utility, will meet the city’s energy needs over the next 10 years. It includes a substantial investment in energy efficiency and a variety of renewable energy resources like wind and solar, as well as new more efficient natural gas plants. In addition to diversifying its generation portfolio, Austin Energy wants to create a self-sustaining market for renewable technologies like solar rooftops and parking lots by 2020.</p>
<p>“A good business practice is to keep your options open when selecting suppliers,” said Steve Taylor of Applied Materials, a semiconductor manufacturer employing more than a thousand Austinites. “This plan allows for a diversity of different energy options, so it protects businesses – and residents – from long-term price spikes for any single power source because other energy supply options will be available and abundant. This plan also enhances Austin&#8217;s efforts to create green businesses and green jobs for years to come.”</p>
<p>The plan is the culmination of a nearly two-year public process of gathering input from multiple stakeholder groups, including businesses, environmental organizations, and groups serving low-income communities. Four representatives from the mayor’s Generation and Resource Planning Task Force, which analyzed more than a dozen scenarios of where Austin could get its power by 2020, are members of the coalition: Phillip Schmandt, chairman of Electric Utility Commission, Cary Ferchill, chair of Solar Austin, as well as non-profit members Public Citizen and Sierra Club.</p>
<p>“The great thing about the plan is its flexibility,” said Matthew Johnson, clean energy advocate with Public Citizen. “If costs for any resource type rise or fall dramatically over the next 10 years, Austin Energy would have the ability to change the plan, and do so with the help of community stakeholders. That’s the beauty of a diverse portfolio of resources. If Austin were locked into building a new coal or nuclear plant, our fate would be sealed.”</p>
<p>Energy efficiency, generally recognized as the cheapest energy resource, would be the main component of the plan. Austin Energy would take a more proactive and coordinated approach to reach low-income households with free weatherization to help lower their electric bills.</p>
<p>“Low-income communities need the most help with paying utility bills,” said Sunshine Mathon, design and development director of Foundation Communities, an Austin-based nonprofit affordable housing organization. “Austin has a long track record of having the lowest bills in Texas because of its commitment to conservation programs that help people lower their bills. My hope is that with the passage of this plan, those programs will not only expand but coordinate with other programs like bill assistance, neighborhood housing and community development.”</p>
<p>Coalition representatives also said that the plan reduces financial risk associated with overreliance on fossil fuels. The plan would enable Austin Energy to ramp down the Fayette coal plant more often, protecting the utility from pending carbon regulation.</p>
<p>“Whether or not you support greenhouse gas regulation, reducing the amount of carbon emissions that Austin is responsible for makes economic sense,” Johnson said. “That’s in addition to the improvements in air quality Austin and the surrounding region would experience. It’s a win-win.”</p>
<p>Austin’s City Council could vote on the plan in March, according to Austin Mayor Lee Leffingwell. He has scheduled a Feb. 22 town hall meeting on Austin Energy’s Resource and Climate Protection Plan. Coalition members urge the public to visit <a href="http://www.cleanenergyforaustin.org/">www.cleanenergyforaustin.org</a> and sign on as well as attend the town hall meeting to show their support.</p>

<p style="text-align:center;"><strong><em>Statement from Tom “Smitty” Smith, director of Public Citizen’s Texas Office and Ken Kramer, director of the Lone Star Chapter of the Sierra Club</em></strong></p>
<p><strong><em> </em></strong></p>
<blockquote><p>This morning Governor Perry attempted to show Texas voters that he is bigger than both Texas and federal law <a href="http://governor.state.tx.us/news/press-release/14253/">by enacting a lawsuit against the Environmental Protection Agency’s(EPA) endangerment finding for carbon dioxide,</a> but instead just further highlighted his failure to protect Texans’ health and the safety and long term stability of our economy and climate.</p>
<p>Instead of suing the EPA, Perry should be taking proactive steps to reduce greenhouse gas emissions and build up our clean energy economy.  Our governor likes to brag about all he’s done to promote wind and energy efficiency and the emissions Texas has avoided as a result, but at the same time he is hammering through a second Texas coal rush that will negate all that hard work and add 77 million tons of CO2 to Texas’ already overheated air.</p>
<p>Perry’s blustering behavior has actually caused Public Citizen to file a lawsuit against the Texas Commission on Environmental Quality for its failure to regulate global warming gasses. Texas law clearly requires that “air contaminants” be regulated, and defines contaminants as follows:</p>
<p><span style="text-decoration:underline;">“‘Air contaminant’ means particulate matter, radioactive material, dust, fumes, gas, mist, smoke, vapor, or odor, including any combination of those items, produced by processes other than natural.” Tex. Health &amp; Safety Code § 382.003(2). </span></p>
<p>Perry has proudly demonstrated willful ignorance of this portion of Texas law time and time again, and has ordered state agencies such as the TCEQ to ignore it as well. For this reason and his actions today we are issuing our Governor a Citizens’ Citation to cease and desist endangering the health of breathers, the economy and the climate in Texas by continuing to permit coal plants and other large sources of CO2.</p></blockquote>

			<content:encoded><![CDATA[<p>Earlier this week <a href="http://texasvox.org/2010/01/28/help-stop-ozone-pollution-show-support-for-proposed-epa-rule/">the Environmental Protection Agency held a public hearing</a> on a newly proposed rule to strengthen federal ozone standards. A coalition of environmental and public health advocates called Clean Air Texas rallied in support of the new rule, which would improve air quality across the state and make our communities healthier.  Over a hundred citizens presented their comments to the EPA in support of the new, stronger rule &#8212; more than the EPA has seen at a public hearing in years.  Public Citizen was on hand to give comments and capture the stories of concerned citizens that came to the hearing, check out the videos below to hear what folks had to say!</p>

<p>Imagine this conversation between a mother and child:</p>
<p>“Mommy, can we go outside and play?”</p>
<p>“Not today, dear, it&#8217;s just not safe.”</p>
<p>Most of us growing up in Texas didn&#8217;t wait for our parents to check an air quality report before venturing outside in the summer. But things have changed. Today, we know that rising temperatures bring rising ozone levels and as summer arrives we&#8217;re forced to restrict outdoor activities to limit harmful exposure.</p>
<p>Still, no matter how hard we try, we just can&#8217;t hide from poor air quality. We&#8217;ve got to clean it up.</p>
<p>That&#8217;s why we are encouraged that the Environmental Protection Agency is proposing new limits on ozone “smog” pollution to protect human health. On Tuesday, the EPA hosts an all-day public hearing at the Houston Hobby Hilton to get your feedback on these proposed stronger standards.</p>
<p>Why should you care about ozone? Ground-level ozone triggers asthma attacks, sends children to the emergency room and can even kill. It&#8217;s a serious health threat — especially in states with warmer climates like Texas. When our abundant sunlight and heat “cook” our equally abundant emissions from traffic and refineries, it forms — you guessed it — too much ozone.<span id="more-6604"></span></p>
<p>In the greater Houston area, hundreds of thousands currently suffer from asthma, chronic bronchitis, emphysema and other lung diseases. Ozone at levels well below the current standards can damage lung tissue and reduce the lungs&#8217; ability to work. This can worsen asthma and chronic bronchitis. Millions of children and older adults are at risk too — risks that may include irreversible lung damage and premature death.</p>
<p>Why strengthen the existing standard? We need stronger, science-based, national air quality standards because the current limits fail to protect our health and our environment. The standards tell communities like Houston how much pollution has to come out of the air we breathe. The scientific evidence, 2,000 pages of it, shows that the standards need to be much, much stronger or millions of children with asthma, and many others, will continue to suffer.</p>
<p>The last EPA administration ignored the standards suggested by its own independent panel of expert science advisers, the Clean Air Scientific Advisory Committee (CASAC), leaving the clear impression that air quality standards were being based on politics and special interests rather than science.</p>
<p>The agency now proposes a standard that would limit pollution concentrations in the range of 60 to 70 parts per billion (as measured over an eight-hour period). We believe that human health would most benefit from implementation of the strongest standard in that range: 60 parts per billion.</p>
<p>What about the costs? As they&#8217;ve done decades before, opponents from industry and political allies will wave their “sky-is-falling” flag claiming that strengthening standards will cost jobs and hinder economic growth. But history tells a different story: Forty years of evidence shows those claims are false. Over time, such guidelines have spurred market innovation, never cost as much as predicted and ultimately resulted in cleaner air for everyone to breathe.</p>
<p>Right now we are paying a high price for our dirty air. The costs of poor air quality are often hidden but are very real: doctor&#8217;s visits, medications, hospitalizations, time missed from work and more.</p>
<p>Finally, we&#8217;ve done it before and we can do it again. We&#8217;ve made great strides in cleaning up our air but still have air that threatens our health and our lives. We ask the citizens of Houston to seize this important moment and come to Tuesday&#8217;s hearing in support of stronger ozone standards.</p>
<p>Leave a legacy of clean air, not only for our health but also for the health of our children and future generations.</p>

			<content:encoded><![CDATA[<p style="text-align:left;">If you were as frustrated as I was watching world leaders dither in Copenhagen while the Earth heats up and island nations continue making evacuation plans, there is good news on the horizon for Austin.<a href="http://www.flickr.com/photos/chromatics/4013525464/"><img class="size-full wp-image-6360 aligncenter" title="austin bridge and sky" src="http://texasvox.files.wordpress.com/2010/01/austin-bridge-and-sky.jpg?w=500" alt=""   /></a></p>
<p>Austin Energy has developed a consensus plan that would establish our own CO2 cap and reduction plan. The great news is that by 2020, Austin&#8217;s investments in solar, wind and energy efficiency would allow us to reduce our dependence on the Fayette coal plant by nearly 30 percent! This energy plan will also bring a wide variety of jobs to the city, from innovative clean technology companies to installation, retrofit and construction jobs.</p>
<p>We need support to pass the plan now!</p>
<p>Public Citizen has helped form a coalition called <a href="http://www.cleanenergyforaustin.org/index.html">Clean Energy for Austin</a>. We&#8217;ve brought together businesses large and small, from Applied Materials to Greenling Organic Delivery, and 12 nonprofits such as the Sierra Club and Environmental Defense Fund to call on City Council to pass the energy plan.</p>
<p>The more individuals and businesses that join the coalition, the stronger the message to City Hall that our world-renowned green city must remain a leader in reducing pollution and creating a green economy.</p>

<p>Some background: This fall, I had the privilege of representing Public Citizen on the city&#8217;s task force charged with analyzing Austin Energy&#8217;s 2020 plan and making additional recommendations. We voted unanimously to upgrade Austin Energy&#8217;s energy efficiency goal, create a special self-sustaining market for local renewable power like solar rooftops and parking lots, and protect consumers&#8217; pocketbooks by conducting periodic reviews in case costs change dramatically.</p>

			<content:encoded><![CDATA[<h3>Part 4. Sunny With a Chance of Economic Development: Solar Potential, the Solar Session that wasn&#8217;t, and City of Austin Solar Plant</h3>
<p>Last spring, our minds were budding with thoughts of birds, bees, and&#8230; <a href="http://texasvox.org/2009/02/03/solar-tech-can-you-make-me-happy-when-skies-are-gray/">Texas&#8217; solar potential</a> (didn&#8217;t you know, a robust solar program would put Texans back to work and position the state as a world leader for solar production!) Ah, sweet romance.</p>
<p>First Public Citizen, Environment Texas and the Lone Star Chapter of the Sierra Club hosted a <a href="http://texasvox.org/2009/02/03/san-antonio-mission-verde-cps-energy-and-real-ultimate-solar-power/">statewide round of press conferences</a> to roll out our solar report, <em><a href="http://www.cleanenergyfortexas.org/downloads/TexasSolarRoadmap.pdf">Texas Solar Roadmap</a></em> (though I&#8217;d really recommend the abridged version, <a href="http://www.cleanenergyfortexas.org/downloads/WildcattingTheSun.pdf">Wildcatting the Sun</a>). It seemed like every other legislator had some incarnation of a solar bill, and folks were wondering if this was going to be <a href="http://texasvox.org/2009/02/05/could-this-be-texas-solar-session/">the solar session</a>. We were (and remain) especially excited about the City of <a href="http://texasvox.org/2009/02/09/more-clean-energy-headed-austins-way/">Austin&#8217;s potential to become the nation&#8217;s new clean energy hub</a>, just like it was for the semiconductor industry &#8212; and almost like an answer to our prayers, within months the<a href="http://texasvox.org/2009/03/05/austin-city-council-votes-for-nations-largest-photovoltaic-array/"> Austin City Council voted in favor of a 30MW solar plant</a> in Webberville (though not without <a href="http://texasvox.org/2009/02/13/city-delays-on-solar-plant-vote/">a little nerve-racking delay</a>).</p>
<p>And of course, somewhere in that busy, busy time, we found time to make an awesome solar video for Environment Texas&#8217; solar video contest:</p>
