At a time when in much of the US we are facing the most significant heat waves in decades, global temperature averages have shown 2010 to be the hottest year ever in recorded history, the National Oceanic and Atmospheric Administration / Climactic Data Center just released its most comprehensive report on climate change which may as well have been called “It’s Real and It’s Here: NOW!”, and droughts, heatwaves, and wildfires are causing Armageddon-like conditions around Moscow, causing even the global warming denying Russian government to capitulate to the scientific consensus…..  Even with all of that, it would seem like an odd time for the state of Texas to send a shot across the EPA’s bow, insulting them and goading them into a fight over Texas carbon emissions and the Clean Air Act.

But yet they have.

Monday August 2nd the state of Texas sent a letter to the EPA (original can be downloaded here) informing them that we would no longer be complying with the Clean Air Act, specifically provisions relating to the regulation of greenhouse gases.  This letter signed by Attorney General Greg Abbott and TCEQ Commissioner Bryan Shaw is full of bluster and short on reasoned legal arguments with any real merit.

What it really remind me of is one of my favorite paintings, Запорожцы пишут письмо турецкому султану or, Zaprozhe Cossacks Writing a Letter to the Turkish Sultan by Ilya Repin.  (For comparison’s sake, I would highly recommend following that link to read the text of the Cossack’s letter– it has language saltier than anything else I’ve heard this side of South Park)  I just can’t help think of the unabashed joy that must’ve coursed through the veins of the Atty General and TCEQ Commissioner as they drafted this, using phrases like (more…)

Governor Perry sent a letter to Congressional leadership and the Texas delegation asking them to strip the EPA of the authority to regulate greenhouse gases, which they were told to do by the Supreme Court in 2007’s Massachusetts v. EPA.

Governor Perry needs to check his facts a little more carefully.

He stated in the letter “Texas is aggressively seeking its future in in alternative energy through incentives and innovation, not mandates and overreaching regulation.”  Gov Perry is correct, in one sense– we have cut our CO2 emissions as a state, but the primary driver of those cuts was the expansion of wind energy that created thousands of new jobs.  And how did we accomplish that?  Through a Renewable Portfolio Standard, or, a fancy term meaning a government mandate.

What Perry should be doing is begging the Federal government to impose a nationwide RPS, which would mean renewable resource poor states would come to Texas to buy our renewable energy the same way they’ve counted on us for our oil and gas in the past.

Further, Perry tries to induce fear by saying EPA regulation would affect “every small business, farm, rancher and family” when the EPA earlier this week said they would only begin regulating tailpipe emissions this year, moving on to power plants which emit more than 100,000 tons of CO2 within the next 2-3 years, then on to other facilities which emit more than 75,000 tons (large facilities like cement kilns or refineries).  This would never affect any small business or church or school…. unless, of course, you go to Carbon Burnin’ High, home of the Flaming Smokestacks!

Governor Perry needs to focus more on bringing these clean energy jobs to Texas and a little less to railing against “the Man” in DC.

AUSTIN – Saying that climate change must be considered when new coal plants and other facilities are approved, Public Citizen today sued the Texas Commission on Environmental Quality (TCEQ) in the Travis County District Court to require the commission to regulate global warming gases. This case seeks to extend to Texas law the precedent set by the U.S. Supreme Court in Massachusetts  v. EPA, which held that carbon dioxide is a pollutant under the federal Clean Air Act and that the U.S. Environmental Protection Agency (EPA) must regulate it.

“Texas leads the nation in the emissions of global warming gases. If we were a nation, we would rank seventh in emissions among the countries on earth,” said Tom “Smitty” Smith, director of Public Citizen’s Texas office. “The time has come for the TCEQ to take its head out of the sand and begin the process to regulate CO2 emissions from Texas sources. Because the agency will not do so on its own, we are seeking to have a Texas court order it to do so.”

In the past four years, 11 coal plants have applied for permits under the EPA’s New Source Review program, which requires companies to install modern pollution controls when building new plants or expanding existing facilities. If they were all to be built, they would add 77 million tons of CO2 to Texas’ already overheated air. Six permits already have been granted for plants that will produce CO2 emissions of 42 million tons per year. Another five are in the permitting stages, and they would add 35 million tons of CO2 per year.

The issue of global warming has been raised by opponents in permit hearings in all but one of the six power plant cases, but the TCEQ has said it would not consider global warming emissions in the permitting process. Beginning this month, hearings will begin on permits for the remaining five plants.

Texas law gave the TCEQ the authority to regulate climate change emissions in 1991. In May 2009, the Texas Legislature passed a series of laws that would give incentives for new power plants that capture carbon dioxide, allow the TCEQ to regulate the disposal of CO2 emissions, set up a voluntary emissions reduction registry and develop a “no-regrets” strategy for emissions reductions to recommend policies that will reduce global warming gases at no cost to the state and its industries.

Smith noted that the TCEQ is undermining even the inadequate mitigation strategies that several coal plant builders are proposing. The NU Coastal plant promised to offset 100 percent of its CO2 emissions, but the TCEQ refused to make that promise part of the permit. Tenaska is promising to separate 85 percent of the carbon it emits, but it is not in the draft permit from the TCEQ. The Hunton coal gasification plant will separate 90 percent of its CO2, but the TCEQ classified it as an “experimental technology” so it wouldn’t set a precedent for other coal plant applications. NRG is promising to offset 50 percent of its emissions.

“Without the TCEQ putting these limits in the permits, there will be no guarantee that the power plant builders will keep their promises,” Smith said.

“The TCEQ steadfastly refuses to allow any discussion or consideration of CO2 or climate change issues during permit proceedings,” said attorney Charles Irvine of Blackburn & Carter, who is representing Public Citizen in the case. “The State Office of Administrative Hearings administrative law judges have deferred to TCEQ’s position that CO2 is not a regulated pollutant and therefore not relevant during contested case hearings. As a result, all evidence and testimony submitted on these issues has been repeatedly stricken in multiple coal plant cases. We now ask the court for a declaratory judgment to force the agency to follow the broad mandates of the Texas Clean Air Act and recent Supreme Court decisions.”

In 2007, the U.S. Supreme Court in Massachusetts  v. EPA recognized that CO2 is an air pollutant within the definition in the federal Clean Air Act. Public Citizen contends that the Texas Clean Air Act’s definition of “air contaminant” similarly must include CO2. Specifically, the state law says that:

“ ‘Air contaminant’ means particulate matter, radioactive material, dust, fumes, gas, mist, smoke, vapor, or odor, including any combination of those items, produced by processes other than natural.” [Texas Health and Safety Code § 382.003(2)]

“So any gas created by non-natural processes – including CO2 generated by a power plant – under the plain language of the definition is an air contaminant,” Irvine said.

The US Chamber of Commerce wants to put the science of global warming on trial.  Not only that, they themselves claim they want this trial to be similar to the Scopes Monkey Trial where a Tennessee teacher was put on trial for teaching evolution, made even more famous by the play and film “Inherit the Wind.”

Seriously?  SERIOUSLY?

Because the only way to respond to this is through mockery and derision (surely they can’t actually be serious?), we present to you:

We apologize for the numerous Saturday Night Live circa 1989 references (especially the somewhat obscure “Unfrozen Caveman Lawyer“) and the blatant callbacks to Inherit the Wind, and also ask people to please NOT place plastic bags on their heads and inhale deeply.  No Andys were harmed in the filming of this video and I was able to breathe freely at all times.  I promise.

On a serious note, what the Chamber is trying to do is to overturn and stall a process which is well underway.  In 2007, the Supreme Court in Massachusetts v EPA stated that CO2 is a greenhouse gas, it is linked to climate change, and the EPA should regulate it under the Clean Air Act.  In compliance with this ruling, (and only after delays by the Bush Administration which kept this action from occurring), the EPA earlier this year presented an initial endangerment finding, the first step in allowing them to regulate CO2 and other greenhouse gases.  They then opened the finding for public comment, which could be sent in by writing, and also held public meetings in Arlington, VA and Seattle, WA to gather public input.

According to documents posted at the Wonk Room, the US Chamber’s main argument is that previous public comment periods have somehow “Tainted” the process and that only an elaborate show trial, orchestrated by them and by putting their junk scientists on the stand, can eliminate the “taint.”  (And you know, “Tainted Endangerment Finding” was one of my favorite 80’s songs.)

So, according to the Chamber, public comment is bad, but the opinion of big business and their sham scientists can remove the stain from input by the witless masses.

All of this seems far too much like the plot of a Coen Brothers (or Marx Brothers) movie.  These are serious times which require serious thought and reflection, not comical misdirection.  But like the Fool in King Lear, only through comedy can we confront the tragedy that surrounds us and point out the serious misdeeds taking place.  And this sham by the Chamber of Commerce is even more destructive, because as long as we keep endlessly debating “Is It Happening?” we will never get around to “How Do We Solve It?”

Breaking News!  Remember back in December, when I was having a daily conniption due to various midnight memos and parting shots from the outgoing Bush administration?  Particularly troubling was former EPA administrator Stephen Johnson’s decision to reverse the landmark Bonanza decision.  Well, now Johnson’s reversal has been reversed.

Last November the EPA’s governance board ruled that its regional office had been too hasty in approving  a new coal-fired power plant in Bonanza, Utah because the plant didn’t include carbon dioxide emissions or control techniques in their permit application.  The Sierra Club helped secure this victory by filing a suit against Utah’s Deseret Power Electric Cooperative for not controlling carbon dioxide. Their argument was based upon the landmark Massachusetts v EPA case, which required the agency to regulate CO2 as a pollutant under the Clean Air Act.  But then at the last minute, outgoing Stephen Johnson issued a memo reversing this decision and saying that the EPA should ignore CO2 emissions when permitting new coal fired power plants.

But REJOICE, for this morning the Sierra Club reports:

Washington, DC: President Obama’s Environmental Protection Agency (EPA) today took the first step toward regulating carbon dioxide emissions from coal-fired power plants. EPA, under the new leadership of Administrator Lisa Jackson, granted a petition from the Sierra Club and other groups calling for reconsideration of an unlawful, midnight memo issued by former EPA Administrator Stephen Johnson which sought to prohibit controls on global warming pollution from coal plants. EPA announced in a letter to the Sierra Club that it will publish a proposed rulemaking in the Federal Register and seek public comments on the decision in the near future.

Today’s decision is consistent with a previous ruling by the EPA’s Environmental Appeals Board (EAB) in the Bonanza case, which found that there was no valid reason for the Bush administration’s refusal to limit carbon dioxide emissions from new coal-fired power plants. The so-called Johnson Memo sought to unlawfully overturn that decision.

Sierra Club, the Natural Resources Defense Council, and the Environmental Defense Fund filed suit against the Bush administration to overturn the Johnson Memo. That litigation will now be put on hold as a result of today’s announcement.

Okay, so the EPA hasn’t officially nixed the memo, but they are posting a proposed rulemaking (to nix it) and inviting public comment.  Not too shabby for a Tuesday.

The decision to grant the Sierra Club’s petition says a lot about the EPA’s new direction and leadership under Lisa Jackson.

Said David Bookbinder, Chief Climate Counsel for the Sierra Club in a press release this morning,

Today’s victory is yet another indication that change really has come to Washington, and to EPA in particular. This decision stops the Bush Administration’s final, last-minute effort to saddle President Obama with its do-nothing policy on global warming.

Not only does today’s decision signal a good start for our clean energy future, it also signals a return to policy based on sound science and the rule of law, not deep pocketbooks or politics. Lisa Jackson is making good on her promises to bring science and the rule of law back into the center of the decision making process at EPA.

We live in exciting times.

The EPA’s newest decision definitely brought the dreaded “F-dash-dash-dash” word to mind.

Reports Grist.org:

Coal-fired power plants’ greenhouse-gas emissions shouldn’t be taken into consideration when determining whether to approve their construction, EPA Administrator Stephen Johnson ruled this week. The ruling could clear the way for at least a handful of new coal plants to be approved in the final days of the Bush administration. “The current concerns over global climate change should not drive EPA into adopting an unworkable policy of requiring emission controls,” Johnson wrote.

Just as I was getting into the holiday spirit, Stephen Johnson has to hit us with this.

In case you’re not quite as obsessed with carbon dioxide regulation and coal plants as we are here at Texas Vox, let me provide a little background.  In November the EPA’s governance board ruled that its regional office had been too hasty in approving  a new coal-fired power plant in Bonanza, Utah because the plant didn’t include carbon dioxide emissions or control techniques in their permit application.  The Sierra Club helped secure this victory by filing a suit against Utah’s Deseret Power Electric Cooperative for not controlling carbon dioxide. The Bonanza decision was, in a word, wicked awesome (okay, two words).  It gave environmentalists a great new tool for stopping coal-fired power plants and signalled a sea change in the government’s willingness to take action over carbon dioxide emissions.  So the fact that the EPA is now telling permitters that they cannot consider greenhouse gas emissions when processing applications  is a major kick in the pants.  It could mean slated plants that wouldn’t have been approved could get the green light during these last weeks of the Bush administration. In a New York Times article, Vickie Patton, from the Environmental Defense Fund estimates that as many as 8,000 megawatts of new coal-fired power plants could skate through as a result of this ruling.

I’m still rather uncertain of what this decision means for the incoming administration.   Lisa Jackson, Obama’s new pick to head the EPA, is considerably more progressive on greenhouse gas emissions than Johnson, and could theoretically reverse this decision.

Reports the Washington Post:

It was unclear yesterday what the ruling’s real-world impact will be. The EPA says that about 50 plants — either new or significantly remodeled — must obtain a permit under this provision every year. But Meyers said he does not know if any are positioned to receive final approval before President-elect Barack Obama takes office on Jan. 20.

The Obama administration is likely to review the case, and Democratic officials close to the president-elect’s team say that the Supreme Court ruling and the EPA’s power to regulate carbon dioxide can serve as powerful levers to bring corporations and other parties to a bargaining table about broad framework for controlling greenhouse gases.
