The booming wind energy industry in Texas didn’t just pop up over night — it was a result of years of research, advocacy, and policy work.  Ever wondered how it all happened?  Smitty, the director of Public Citizen’s Texas Office, has a story to tell — check it out!

Seeing as we are just at the beginning of the history of wind, it is a story that is constantly evolving.  Coastal wind projects have been developed in Texas recently (look for a post on this very topic soon!).  Just this week, the Abilene Reporter News ran an article about a local professor and director of the Wind Science and Engineering Research Center at Texas Tech that testified on a bill in Congress that would pump $200 million annually into research and development for wind power.  While wind is of course a viable industry in its current stages, further R&D will allow it to provide an even larger portion of our total electricity needs, operate more efficiently, and be an even cheaper and more reliable form of energy.

While you’re at it, check out this recent article from the Guardian about the “furious search for practical, affordable electricity storage” so that excess energy produced when the wind is blowing but no one’s lights are on can be socked away and used when we need it most.

The Texas Legislature failed to update state energy codes for new commercial, industrial, and residential buildings. That doesn’t mean Texas can’t move forward. We can get the job done in other ways.

There is a silver lining to this spring’s legislative shortfall: proposed rulemaking at the State Energy Conservation Office (SECO) to update the state minimum building codes from 2001 to 2009 may move faster than the proposed legislation would have required.

Adopting the 2009 IECC or IRC will lead to the following changes in residential construction:

  • Homes will be tested or inspected to allow less air leakage and less thermal infiltration, leading to less energy use.
  • Ducts will be sealed and tested or located in conditioned space to ensure that heating and cooling equipment functions efficiently.
  • Windows will meet lower U-factor and lower SHGC requirements, leading to substantial reductions in the amount of air conditioning needed. (Note that the IECC sets a more stringent SHGC requirement than the IRC.)
  • At least half of light fixtures will have to be “high efficacy.” (Lights have not been included in previous residential energy codes.)

On June 5th, SECO opened a 30-day comment period on updating the residential energy codes based on the 2009 IRC Codes. Take a moment today to send your comment of support for updated energy codes! Comments are due to SECO before 5 pm on July 5.

Failure to update our standards quickly and effectively would be a step backwards and could potentially impact current or future funding from the federal government.  Texas lags behind many states on its Energy Codes (see map). The nation is moving to update energy efficiency codes, with Congress considering a single national building code standard.  Under the American Renewal and Recovery Act (the federal economic stimulus program), Texas has submitted a letter to the Department of Energy saying it has a process to update its standards, allowing SECO to accept certain grants for energy efficiency.

Take action today and send your comment to SECO to support new, green energy codes in Texas!

iphoneA new iPhone application My Texas Lege will make it even easier for constituents to contact elected officials and their staffers.  The app, which has both a paid (Plus) and free version (Lite), is a nonpartisan directory of the Texas Legislaturethat will allow users to dial members’ offices directly, find district offices using Google Maps, and email members and staffers directly from your phone.  The application is available now, and starting in Fall 20090 will include a 2010 Campaign Expansion Pack with information on all state races.

I love technology.

The special session that Governor Rick Perry called started this morning.  On the agenda: extending the life-line of several state agencies that were up for review, such as the Department of Transportation, Insurance, Public Insurance Counsel, and the Texas Racing Commission and the State Affordable Housing Corporation.  If legislators don’t pass a bill to extend these agencies, they will expire next Septemeber with nothing to replace them.

Perry has also called for legislators to authorize $2 billion in road-building bonds.

That’s all that’s on the agenda.  As the AP quoted Perry saying, “Get’em in, get’em out and get the work done. Badda bing, badda boom!”

Technically, the session once called lasts 30 days, but if lawmakers get their work done early they will leave at that point.  According to the AP, Perry seems pretty confident that legislators will be home in their districts in time for Fourth of July fireworks.

Environmental Groups See Clean Energy Groundwork Laid for the Future

(Austin) Senate and House members from both political parties showed unprecedented support for developing more renewable energy and energy efficiency in Texas by filing a large number of clean power, green jobs bills in the 81st Texas State Legislature. A number of major bills passed either the House or the Senate. Ultimately, political disagreements over other issues and over the size and extent of the programs delayed and killed most of these excellent legislative initiatives.

Environmental groups Sierra Club, SEED, Public Citizen, Environmental Defense Fund, and Environment Texas applaud the passage of some clean energy, green jobs legislation and view the Legislature as having laid ample groundwork for the future.

“The fact that both the House and the Senate passed major legislation on energy efficiency and renewable power with bipartisan agreement shows that Texas leaders are willing and able to develop clean power and green jobs for our state,” noted Cyrus Reed, Conservation Director of the Lone Star Chapter of the Sierra Club. “Nevertheless, leaders were distracted by undue influence from industry interests and by the Voter ID debate which hampered passage of clean energy bills and other more vital areas of legislation.”

“Texas is moving more slowly than a melting glacier toward developing global warming policy. Rather than implementing already available energy efficiency and distributed energy solutions, Texas’ response to global warming is to develop futuristic industrial-sized solutions. As a result the state has legislation pending that may develop standards for large scale carbon sequestration projects and provide incentives to get companies to develop the technologies,” said Tom “Smitty” Smith, Director of Public Citizen’s Texas office. “On the positive side, the state has passed a study to develop a series of ‘no regrets’ solutions to global warming that the State can achieve at no cost. Also, the Texas House, especially the House Committee on Environmental Regulation, should be applauded for their more open leadership style this session which lead to far more reasoned and less ideological bills being developed in the committee.”

Clean Power, Green Energy Bills that passed both bodies and will go to the Governor (as this release goes to press):

  • Green fleets legislation to promote low emissions and plug-in hybrid vehicles for fleets of major State Agencies (HB 432);
  • Legislation allowing cities to create financial districts to loan money for renewable power and energy efficiency (HB 1937).
  • Legislation setting a ‘no regrets’ strategy for greenhouse gas reduction in the State; a study of the state’s energy use to find ways to reduce our emissions and save money at the same time (SB 184)
  • A coordinated green jobs strategy including funds allocated for child care programs, vocational training initiatives, energy efficiency measures, the Weatherization Assistance Program (WAP), and/or any other recovery funds (passed as a Rider to Article 12).
  • Green fee bill passed allowing governing board of public colleges and universities to institute an environmental service fee once approved by student body election.

“This has been a disappointing session,” said Luke Metzger, Director of Environment Texas. “However, with the passage of HB 1937, we can start the ball rolling on developing Texas’ solar future, working with local communities one at a time to start financing solar and energy efficiency projects.”

Groundwork Laid for Next Session

The major Clean Power, Green Jobs bills that passed the House or Senate but did not ultimately make it to the Governor’s Desk include:

  • Raising the state’s minimum residential and commercial building codes from 2001 to 2009 standards (passed Senate as SB 16 and HB 2783 in House);
  • Raising the utility efficiency goal (SB 546 passed both houses but no agreement was reached between Senator Fraser and Representative Anchia on the size of the goals)
  • Adopting appliance efficiency standards for a variety of products, including pool pumps (passed Senate as SB 16)
  • Creating a 1,500 MW Emerging Technology Renewable Standard (SB 541 – passed the Senate)
  • Creating a $500 million solar incentive program (SB 545 – passed the Senate).
  • Creating a Policy requiring utilities and retail electric providers to pay consumers fair buyback rates for excess electricity generation from renewable energy (HB 1243 – passed House and Senate, but was killed in the House through concerns over germaneness and Senate amendments.);
  • High performance energy efficiency building standards for state buildings, including universities and public schools (HB 431). The Senate may pass the conference committee report today, on Sine Die.

Factors which prevented bills with bipartisan support from making it across the finish line:

  • The issue of Voter ID, which put many major efficiency and renewable bills too far down the calendar for consideration in the House;
  • A disagreement over the germaneness and concern over the possible costs to low-income residents of adding the solar incentive bill (SB 545) to the surplus electricity bill (HB 1234), which led Representative Turner to ultimately kill consideration of the bill on the House floor;
  • The election of a new Speaker and the naming of new Committee Chairman understandable led to some delays in getting the committees up and running to begin to consider bills;
  • Disagreement between House and Senate on size and scope of goals set by solar and energy efficiency bills (SB 545 & 546);
  • Disagreement over the potential costs and benefits of the Renewable Portfolio Standard (SB 541);
  • Opposition from the Texas Manufacturers Association, the Governor and many utilities against the Renewable Portfolio Standard.

“We were happy to find some new allies this session including certain members of the legislature and some electric utilities that said they supported renewable energy and energy efficiency legislation,” said Jim Marston, Director of Texas Regional Office of Environmental Defense Fund. “Sadly, some of the electric companies talked a good game, but their support evaporated when opposed by their affiliated retail electric providers or others in the industry. In the end, the Association of Electric Companies of Texas reverted to representing the interests of the regressive elements of their membership harming the ability of Texas to participate successfully in the new energy economy.”

“Moreover, the Texas Association of Manufacturers (TAM) while acknowledging that an expanded renewable portfolio standard was the way to bring clean technology jobs to Texas, distributed false cost information about solar legislation that was repudiated by the PUC and others. The bottom line, TAM fought legislation that would have brought new manufacturing jobs to Texas,” said Marston.

Nuclear Bills Blocked

Environmental groups blocked bad bills that would have removed citizen rights to contest permits and would have promoted nuclear power in the State which many view as a financial drain from investment in truly clean energy.

“Nuclear power is expensive, consumes vast quantities of water, comes with serious security and health risks and creates radioactive waste, for which there is no good storage solution. We were happy to block two bad bills this session that were designed to benefit proposed nuclear reactors in Texas,” said Karen Hadden, Director of the Sustainable Energy and Economic Development Coalition.

The nuclear bills that were blocked:

  • Fast tracked water permits for nuclear power plants and cut out contested case hearings (HB 2721 was left pending in House Environmental Regulation Committee)
  • Subsidies for proposed nuclear power plants in the form of tax rebates (HB 4525 passed the House and was blocked in the Senate.)

“Representative Flynn’s bill would have fast-tracked water permits for nuclear plants, an outrageous attempt in a time of statewide drought,” said Hadden. “It would also have denied citizens an opportunity to contest issuance of the permits through hearings, an assault on democratic process. The other bad bill that we defeated would have given massive subsidies to nuclear power in the form of tax rebates.”

Miscellany

  • A good bill to address the Compact Loophole for the Andrews County Low-Level Radioactive Waste Dump bill, HB 3423 Lon Burnam did not get out of Committee.
  • Environmental groups blocked a bad provision that would have fast tracked water permits for “clean coal” plants in the final version of HB 469 and added cleaner emissions standards for those plants.
  • HB 821 passed, requiring television manufacturers that sell televisions in Texas to make free and convenient recycling available. Texas Campaign for the Environment successfully advocated for this bill.
  • Sen. Ellis used a threatened filibuster last night to kill HB 3827 which would have allowed oil companies to evade liability for MTBE water contamination;
  • SB 2169 Sets up an interagency working group, co-chaired by the Texas Commission on Environmental Quality, the Texas Department of State Health Services, the Texas Department of Transportation with other agencies to discuss smart growth and make recommendations for developing the state in a sustainable way.
  • An amendment to HB 300 creates a certification program for environmental coordinators in Texas Department of Transportation district offices. This bill is still in conference committee as this release goes to press.

“As it concludes, environmentalists can view this legislative session with some hopefulness – the Legislature is definitely involved and interested in clean energy and green jobs and did move these issues forward. But there is also some sadness – an opportunity to move significantly forward on clean energy was lost,” Cyrus Reed added. “Jobs that could have been created, and new sources of clean energy that could have been advanced in Texas were delayed this Session.”

Well, the sun has just about gone down on the so-called “solar session”.  Today is Sine Die — the last day of the legislative session.  Friday night, HB 1243 — solar’s last lifeline — was killed on the House floor.

Earlier in the week, Rep. Warren Chisum called for a strict enforcement of the House rules on germaneness.  As you may recall, last week we were pretty excited around here that the solar and electric coop reform bills were tacked onto the net metering bill because they were related enough to be considered germane.

But they weren’t germane enough under STRICT enforcement of the rules, so the bill was killed.

I waited to break the news, because we still had a chance to amend SB 545  to the energy efficiency bill, SB 546… but that didn’t work out either.  The House and Senate authors of the bill (Anchia and Fraser) simply could not agree over the size and scope of the solar and efficiency goals, so the bill never made it out of conference.

Its all rather depressing.  Feel free to join my Tom Waits/ James McMurtry/ Leonard Cohen Pandora radio station and wallow in grief.  Leave a comment and I’ll send you an invitation.  But no need to worry about Citizen Sarah getting dangerously down in the dumps… I’ve left my Townes Van Zandt CDs in the car, and am headed out to the river tomorrow.  Will be back to my chipper self before too long.

Plus… the session wasn’t a total loss.  It just wasn’t all that we dared hope for.  As of right now, here’s a list of bills that passed both bodies and will go to the Governor:

nuke plantA bill currently moving in the Texas Legislature, HB 4525, would create new state subsidy of $50 million each for new nuclear and coal plants.

We need your help to stop this pork bill from passing.  Call your Senator now and tell them that nuclear power doesn’t need taxpayer help!

Although the claim of HB 4525 is that subsidies are necessary to attract new manufacturing plants to Texas, the bill would actually primarily reward plants already intending to build here with a totally unjustified housewarming gift.

In particular, the two nuclear projects singled out by the Legislative Budget Board analysis as the most likely beneficiaries of these subsidies –the South Texas Project and Comanche Peak — are expansions of existing complexes.  We aren’t in danger of these facilities relocating to out of state, and giving them $50 million a pop “to stay” is an extravagant waste of taxpayer money.

At a time of economic crisis, when state tax revenues are plummeting, Texas cannot afford to give that kind of money away, especially to such financially and environmentally risky projects.

Nuclear plants are already the most heavily subsidized energy industry in the United States at both the state and federal level. Coal plants are heavily subsidized as well, and the Texas Legislature is currently considering two new subsidies for “clean coal” projects. Considering the likelihood that a cap-and-trade bill will take effect soon, this is the wrong time to be adding financial support to the quickly changing energy industry.

Call your Senator today, and tell them to STOP this new coal and nuclear subsidy by voting NO on HB 4525.

Bad news from the big pink dome. Looks like two of our key bills to promote solar power this session, SB 545 (Fraser/Strama) and SB 541 (Watson/Farabee) are getting stuck in the gummy gears of the legislative process. These bills have both made it through committee and the Senate, but still need to be voted on by the House. Unfortunately, they may never make it that far due to the tremendous power of a little group called the House Committee on Calendars.

At this point, Calendars has an incredible amount of power over what bills will make it to become laws this session. There are now just ten days left before sine die, and hundreds of bills left waiting to go to the House floor. Calendars is like the legislative bouncer at this point, only letting certain skinny, sexy, well-dressed bills into the club.

SB 545 has yet to come out of Calendars, and SB 541 hasn’t even made it onto the list yet. If 541 isn’t at least on the list by tomorrow, it is dead. If 545 hasn’t made it from the list and into the club by Sunday, it’ll be the bill’s last chance to shine.

You think old Bill had it had it bad, at least he didn’t have a Calendars committee to hold him up.

With the deadline for House bills to pass third reading last Friday at midnight, the 81st Session entered its final phase. The good news is that seven of ACT’s high priority bills have made it to the last two weeks of the session. Here’s a run-down of the bills’ current status:

On Monday, the Texas House will decide whether to promote solar energy by requiring utilities to pay consumers fair prices for surplus solar power or to codify anti-consumer practices in order to benefit big utilities like TXU. Here’s the story.

Sick of riding the rollercoaster of high electric rates and concerned over pollution and dependence on foreign oil, many Texans are turning to solar power to get more choices than their electric company provides. More than 40 states help consumers do this by requiring electric companies to pay a fair price for the surplus electricity solar panels put back on the grid (known as net metering). In return, the electric grid benefits from a supply of pollution-free electricity during peak-demand time periods, such as hot summer afternoons, avoiding congestion costs and dampening real-time on-peak wholesale energy prices. The more renewable generation that is located at customer’s houses and businesses, the less will need to be charged in the future to all customers’ electric bills for wires, fuel and pollution costs. Incentivizing solar will also help create jobs and attract manufacturers to the state.

In addition to consumer rebates and tax credits, net metering is a key financial driver making solar power a cost-effective investment for consumers. Texas had such a policy in place in the 1980s, but with the restructuring of the electric market, old definitions of electric utilities no longer applied and net metering was inadvertently ended. The Chosen Ones

There’s a lot to celebrate this Earth Day when it comes to the Texas Legislature. Republicans in both chambers are carrying environmental legislation – if for no other reason than to stick it to the feds before the feds, under President Obama and a Democratic Congress, begin regulating the environment themselves. And Speaker Joe Straus has been a boon to environmental bills, as well, since he’s actually letting the legislators run the show in the House, unlike his predecessor.

The upshot? More good environmental bills and fewer bad ones.

Luke Metzger, director of Environment Texas, says there are just two main bad bills this session. Both would both speed up the permitting process for power plants. Rep. Dan Flynn’s HB 2721, which is being heard today in Environmental Regulation, would speed it up for nuclear plants. The other bad bill, Rep. Randy Weber’s HB 4012, would fast-track permitting for coal power plants.

And I know it’s unlike us to report good news, but Tom “Smitty” Smith, director of Public Citizen in Texas, says he is “suffering from a crisis of abundance” when it comes to all the worthwhile environmental bills this session.

“There are more good bills in the lege session than I can keep up with,” Smitty says. “It is reminiscent of the 1991 legislative session when Ann Richards was elected and there was a wave of reform. This is the best session I’ve had in 18 years.”

If you live in the Waco, Sweetwater, Corpus Christi, or Victoria area, you may have seen this op-ed run in your local newspaper under a variety of titles such as “Stop the Dirty Dozen”, “New generation of grandfathered polluters?”, and “Don’t create another generation of grandfathered power plants.” If not, you should give it a read.

smitty-mug2In the early 1970s, when it looked like the passage of the federal Clean Air Act was inevitable, power companies in Texas went on a building boom to construct 12 dirty, old-technology power plants before legislation went into effect. It was more than 30 years before the Texas Legislature addressed pollution from these “grandfathered” plants. Today, just as Congress and the Obama administration are poised to pass a series of tougher air pollution laws and cap global warming gasses, a dozen applications for additional coal fired power plants in Texas have been permitted or are pending. If built, this dirty dozen of coal plants would add an astounding 77 million tons a year of global warming gases to our already overheated air, 55,000 tons of acid rain forming gases, 29,000 tons of ozone forming chemicals and 3,800 lbs of brain damaging mercury. Your call to your state senator this week can help stop another generation of coal plants from being built.

Two years ago, 19 new coal plants were proposed for the state of Texas. Everybody breathed a sigh of relief when TXU withdrew applications for eight of those plants. But other companies are still building their proposed plants, and the cumulative impacts will make it harder to breathe in the DFW, Houston, Tyler- Longview, Waco, Austin, San Antonio, Victoria and Corpus Christi areas. Seven of the plants have already been permitted, but five more are still in the permitting stages and can be more easily stopped.

Sen. Kip Averitt took a strong stand on this issue by adding a provision in his aggressive air qualtity bill, SB 16, to require the Texas Commission on Environmental Quality to look at the cumulative impacts of any proposed new plant along with any others that have already been permitted or are being proposed. This amendment would have gone a long way to protect our air and climate.

Unfortunately the electric companies out-lobbied him and took a red pen to that provision of the bill. What’s left is too little and too late. (more…)

Rep. Jim Dunnam of Waco, leader of the House Democratic Caucus, stunned observers at a hearing this afternoon by lining up what looked like shots of whiskey on the members’ dais in the hearing room and then gulping down several to buttress a point about the cumulative impact of air pollution.

But rest easy, Temperance League.

Dunnam said after shot three that the brownish liquid in the shot glasses was iced tea.

This is such a beautiful analogy.  Chairman Dunnam made this point while explaining HB 2495, “AN ACT relating to the consideration of the cumulative effects of emissions from proposed facilities in actions by the Texas Commission on Environmental Quality on applications for certain air contaminant emissions permits or permit amendments.”  With a total of 9 lines and less than 200 words, this was very simple.

When permitting new coal-fired power plants, current TCEQ policy does not consider the cumulative effects of the emissions from those plants.  That means that if eight coal stacks were to be built within one county, as they were in McLennan county in 2007, then TCEQ can consider each of the proposals only as an individual entity and its potential to cause harm to health and quality of life.  As Rep. Dunnam illustrated, the effects are cumulative, whether you drink one shot in Waco, one in Houston, one in San Antonio, etc. (more…)

Hundreds of youth from all over Texas will converge at a rally and a lobby day at the State Capitol for clean energy and climate justice! We will lobby for:

* Increasing distributed solar to 2,000MW of generation
* Stopping all new coal-fired power plants
* Creating programs that help disadvantaged youth stay on track to complete high school while improving energy efficiency in low-income homes

This promises to be a powerful moment in Texas grassroots politics. Join us 9:30am-10:30am for great speakers from the movement and the State Legislature including Senator Rodney Ellis, Representative Tara Rios Ybarra, and Public Citizen Director Tom “Smitty” Smith.

Lobby Day training will happen on Sunday, March 29th, 3:45pm-6:00pm. This training is crucial for those who want to play speaking roles during lobby visits. We will have materials, Q&A, and role play exercises.

The Texas Legislature only meets every 2 years. If we want a clean and just energy future for Texas, we have to go to the Capitol and make our voices heard. Join us!
